Discover® Debit Security Alerts Terms and Conditions

Discover Debit Security Alerts are provided by PULSE, a wholly-owned subsidiary of DFS Services LLC which is affiliated with Discover Product Inc and under the common control of Discover Financial Services (“Discover”). By agreeing to receive Discover Debit Security Alerts, you agree to these terms (the "Agreement"). Please review this Agreement regularly because it may change. We will post modifications we make to this Agreement on this page. We reserve the right to stop providing Discover Debit Security Alerts to you at any time.

Discover Debit Security Alerts provide you with: (a) daily monitoring of your Experian® credit report and an alert when a new inquiry or account is listed on your report; (b) daily monitoring of thousands of Dark Web sites known for revealing personal information and an alert if your Social Security Number is found on such a website. We will automatically enroll the Social Security Number associated with the Primary debit cardmember for the website monitoring.

This information is intended for, and only provided to, Primary debit cardmembers whose accounts are open, in good standing and have an email address on file. The Primary cardmember must agree online to receive identity alerts and those alerts will be delivered to the primary email address on file. Identity alert services are based on Experian® information and data which may differ from information and data at other credit bureaus.

Discover is not a credit repair organization as defined under federal or state law, including the Credit Repair Organizations Act.

Who Can Receive Discover® Debit Security Alerts

You must be a U.S. resident or a resident of America Samoa, Guam, Northern Mariana Islands, Puerto Rico or the Virgin Islands to receive daily monitoring of your Experian® credit report for new accounts listed on the report. Also, you must be at least 18 years old.

In some cases, you may not have an Experian® credit report, in which case we cannot provide alerts. For example, you may not have a report because your credit history may be too new; you may have a foreign address; or you may have key information that is mismatched or missing, such as an address change that has not been updated with the credit bureau.

You agree that You will use Discover Debit Security Alerts only for your own behalf. You will be responsible for all use of your membership number and must notify Discover immediately of any unauthorized use of your membership number, or the theft or misplacement of your membership number.

You understand that by enrolling in the Discover Debit Security Alerts service, You are providing "written instructions" in accordance with the federal Fair Credit Reporting Act, as amended ("FCRA"), for Discover and its service providers, which may include CSIdentity Corporation (“CSID”) to obtain information from your personal credit profile from Experian, Equifax, and Transunion, the three major credit reporting agencies. You authorize Discover and its service providers to use your Social Security number to access your personal credit profile, to verify your identity, and to provide credit monitoring, reporting, and scoring products.

You must have a valid email address to receive alerts.

Obtaining your Credit Information

You authorize Discover to obtain your credit report and score from one or more credit bureaus. Unless you cancel this authorization, we'll pull fresh credit report information for you daily.

You may cancel your Discover Debit Security Alerts at any time.

You can get a free credit report annually from Experian, Equifax and TransUnion. For more information go to www.annualcreditreport.com or call 1-877-322-8228.

NO WARRANTY

YOU AGREE THAT YOU ASSUME ALL RISK FOR YOUR USE OF DISCOVER DEBIT SECURITY ALERTS, AND THAT THEY ARE PROVIDED "AS IS". DISCOVER DOES NOT WARRANT THE ACCURACY, ADEQUACY OR COMPLETENESS OF THE INFORMATION AND SERVICES PROVIDED AND EXPRESSLY DISCLAIMS LIABILITY FOR ERRORS OR OMISSIONS. NO WARRANTY OR REPRESENTATION OF ANY KIND, IMPLIED, EXPRESSED OR STATUTORY INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF NON-INFRINGEMENT OF THIRD PARTY RIGHTS, TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND FREEDOM FROM COMPUTER VIRUS, IS GIVEN IN CONJUNCTION WITH THE INFORMATION AND SERVICES PROVIDED. NO ADVICE OR INFORMATION OBTAINED BY YOU FROM DISCOVER OR THROUGH OR FROM DISCOVER DEBIT SECURITY ALERTS WILL CREATE ANY WARRANTY OF ANY KIND.

LIMITATION OF LIABILITY

YOU UNDERSTAND AND AGREE THAT DISCOVER AND ITS SUPPLIERS AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS AND EMPLOYEES WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES RESULTING FROM OR IN ANY WAY CONNECTED TO YOUR USE, OR INABILITY TO USE THE PRODUCTS, MEMBERSHIP BENEFITS, OR CONTENT EVEN IF DISCOVER OR ITS SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. SOME JURISDICTIONS EITHER DO NOT ALLOW OR PLACE RESTRICTIONS UPON THE EXCLUSION OR LIMITATION OF DAMAGES IN CERTAIN TYPES OF AGEEEMENTS; FOR THESE JURISDICTIONS, THE AFOREMENTIONED LIMITATION ON LIABILITY SHALL BE TO THE MAXIMUM DEGEE PERMITTED BY APPLICABLE LAW.

Indemnification

You agree to indemnify, defend and hold harmless Discover, its affiliates and their respective officers, directors, employees, agents, successors and assigns from and against any actual or alleged claims or losses arising from, in connection with, or based on allegations whenever made of, any of the following: your breach of this Agreement; your use of Discover Debit Security Alerts; any claim that your use of your Discover Debit Security Alerts violates any applicable law; or any claim arising out of, or in connection with, your negligent acts or omissions. This obligation shall survive the termination or expiration of this Agreement. You will cooperate as fully as reasonably required in the defense of any claim. Discover reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

Trademark Information

DISCOVER and the other trademarks, logos, and service marks displayed on Discover Debit Security Alerts are the trademarks of Discover, its affiliates or their respective third party owners. Under no circumstances may you alter, modify, or change these trademarks. You are prohibited from using these trademarks for any purpose without written permission.

Third Party Beneficiaries

Either of us, including any of the Discover family of companies, is entitled to enforce rights under these terms. Otherwise, no other person or company will be a third party beneficiary to these terms.

Assignment

If we need to, we may assign rights under this Agreement to another party. You may not assign your rights under this Agreement.

Arbitration

You, on the one hand, and Discover and/or Discover’s service provider(s), on the other, agree that any claim or dispute ("Claim") between us shall, at the election of any one of us, be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its rules for consumer arbitrations. It is the parties' intent that this arbitration provision be construed broadly, including that this arbitration agreement include any Claims by You against Discover or Discover’s service provider(s) as well as their respective corporate affiliates for claims arising out of this Agreement directly related to the services or product/service websites. However, any disputes or claims you may have which relate to your credit report, or any claims arising out of or relating to the Fair Credit Reporting Act (“FCRA”) and/or the FCRA’s state law equivalent(s), are not subject to or governed by this agreement to arbitrate. You agree that, by entering into this Agreement, You, Discover and Discover’s service provider(s) are each waiving the right to a trial by jury or to participate in a class action. At your request, we will promptly reimburse you for your payment of your arbitration filing fee. (The filing fee currently is $200 for claims under $10,000 but is subject to change by the arbitration provider. If you are unable to pay this fee, we will pay it directly after receiving a written request). The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual Claim. YOU, ON ONE HAND, AND DISCOVER AND/OR DISCOVER’S SERVICE PROVIDER(S), ON THE OTHER, AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both You and Discover agree otherwise, the arbitrator may not consolidate more than one person's Claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision in the preceding sentence is found to be unenforceable, then the entirety of this arbitration provision in this Section shall be null and void. Notwithstanding any of the foregoing provisions, any party may bring an individual action in small claims court. The parties to this Agreement acknowledge that this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq. ("FAA"). Judgment upon any arbitration award may be entered in any court having jurisdiction. The arbitrator shall follow substantive law to the extent consistent with the FAA and shall honor any claims or privileges recognized by law. The terms of this Section shall survive any termination, cancellation or expiration of this Agreement.

FICO Credit Score Disclosure

FICO® Scores are developed by Fair Isaac Corporation. The FICO® Score provided by ConsumerInfo.com, Inc., also referred to as Experian Consumer Services (“ECS”), in Experian CreditWorks℠, Credit Tracker℠ and/or your {Product Name} membership (as applicable) is based on FICO® Score 8, unless otherwise noted. Many but not all lenders use FICO® Score 8. In addition to the FICO® Score 8, ECS may offer and provide other base or industry-specific FICO® Scores (such as FICO® Auto Scores and FICO® Bankcard Scores). The other FICO® Scores made available are calculated from versions of the base and industry-specific FICO® Score models. There are many different credit scoring models that can give a different assessment of your credit rating and relative risk (risk of default) for the same credit report. Your lender or insurer may use a different FICO® Score than FICO® Score 8 or such other base or industry-specific FICO® Score, or another type of credit score altogether. Just remember that your credit rating is often the same even if the number is not. For some consumers, however, the credit rating of FICO® Score 8 (or other FICO® Score) could vary from the score used by your lender. The statements that “90% of top lenders use FICO® Scores” and “FICO® Scores are used in 90% of credit decisions” are based on a third-party study of all versions of FICO® Scores sold to lenders, including but not limited to scores based on FICO® Score 8. Base FICO® Scores (including the FICO® Score 8) range from 300 to 850. Industry-specific FICO® Scores range from 250-900. Higher scores represent a greater likelihood that you'll pay back your debts so you are viewed as being a lower credit risk to lenders. A lower FICO® Score indicates to lenders that you may be a higher credit risk. There are three different major credit reporting agencies — the Experian credit bureau, TransUnion® and Equifax® — that maintain a record of your credit history known as your credit report. Your FICO® Score is based on the information in your credit report at the time it is requested. Your credit report information can vary from agency to agency because some lenders report your credit history to only one or two of the agencies. So your FICO® Score can vary if the information they have on file for you is different. Since the information in your report can change over time, your FICO® Score may also change.
